Terms and Conditions for Cibolo Creek Cattle Company, LLC
1. Introduction
These Terms and Conditions govern the sale, purchase, and acquisition of products through Cibolo Creek Cattle Company, LLC, and its owners, directors, employees, agents, and representatives ("the Company"). By purchasing, handling, making a deposit on, or acquiring the Company’s products, you agree to be bound by these Terms and Conditions. A customer shall mean any person, household, company, or organization purchasing, handling, making a deposit on, or acquiring the Company’s products. Cibolo Creek Cattle Company, LLC including but not limited to its owners, directors, employees, agents, and representatives, (collectively referred to as "the Company"), provides food products and services on an "as is" and "as available" basis without any warranties, express or implied. The Company disclaims all liability related to product quality, accuracy of marketing claims, food safety, and any other aspect of the business operations. By purchasing, consuming, handling, or using any products from the Company, customers acknowledge and accept all terms set forth in this agreement. By purchasing, consuming, handling, or using any products from the Company, you agree to be bound by these Terms and Conditions.
2. Liability Disclaimer
The Company provides food products on an "as is" and "as available" basis without any warranties of any kind, express or implied. The Company makes no representations or warranties regarding the quality, freshness, nutritional value, allergen content, or safety of any products sold. The customer assumes all risks associated with the purchase, storage, preparation, and consumption of any food items. The Company is not responsible for any allergic reactions, illnesses, injuries, or other damages resulting from the use or consumption of its products, including but not limited to foodborne illness, choking hazards, contamination, improper storage, or allergic reactions. The Company is not liable for any discrepancies on marketing claims. The customer acknowledges that food safety guidelines must be strictly followed to ensure the proper handling of products and that failure to do so may result in harm for which the Company is not responsible.
3. Exclusion of Liability
Cibolo Creek Cattle Company, LLC including its owners, directors, employees, agents, and representatives (collectively referred to as "the Company"), shall not be legally, financially, or criminally liable for any claims, damages, losses, injuries, or issues arising from or related to its business operations, including but not limited to foodborne illness, product safety, marketing and advertising claims, delivery and logistics issues, customer storage and handling errors, third-party supplier actions, risks associated with customer use and consumption, regulatory compliance issues, force majeure events, and data security breaches.
The Company is not liable for any foodborne illness resulting from the purchase, storage, handling, preparation, or consumption of products sold by the Company. This includes but is not limited to cross-contamination of food products (including allergens, bacteria, or foreign substances), spoilage due to shipping delays or improper storage, consumption of raw or undercooked foods (including but not limited to meat, poultry, seafood, dairy, and eggs), and any adverse reactions due to food allergies, intolerances, or sensitivities. The customer assumes full responsibility for verifying ingredient safety and following proper food storage and preparation guidelines. The Company is also not responsible for any inaccuracies in expiration dates, “best by” dates, or storage recommendations.
The Company is not liable for any issues related to delivery, shipping, and logistics, including but not limited to delays in shipment or delivery caused by weather conditions, supply chain disruptions, labor shortages, or other errors. The Company is not responsible for damage to packaging or contents during shipping, incorrect deliveries due to customer-provided address errors, or theft or loss of delivered products once delivery has been completed and confirmed.
Customers are solely responsible for the proper storage and handling of food products upon receipt. The Company is not liable for any degradation in product quality due to improper refrigeration, freezing, storage, or handling by the customer. Any food spoilage due to failure to follow USDA and FDA food safety guidelines is the sole responsibility of the customer. It is the customer’s responsibility to inspect all packaging upon delivery to ensure quality and safety before acceptance. Any issues regarding improper cooking methods, failure to cook food items to safe internal temperatures, or failure to follow provided preparation instructions shall not be the responsibility of the Company.
The Company is also not responsible for actions or errors committed by third-party suppliers, manufacturers, or ingredient sources. This includes but is not limited to unexpected changes in product formulations, supplier substitutions, inaccuracies in ingredient lists, cross-contamination with allergens due to supplier processing methods, pathogens that cause foodborne illness, and the presence of contaminants or foreign objects introduced during third-party manufacturing processes.
The Company does not guarantee the accuracy of any marketing and advertising claims, including but not limited to product descriptions, advertisements, website content, and promotional messages. In the event of discrepancies between marketing materials and the official government-approved labels on food packaging, the government labels shall take precedence as the final authoritative source. Claims including but not limited to health benefits, nutritional content, ingredient sources, organic certification, gluten-free status, keto-friendliness, or other dietary characteristics may not apply to all products sold, and the accuracy of such claims may vary due to changes including, but not limited to product formulation, market conditions, supplier modifications, or industry standards. Any statements referencing “best practices” or “industry standards” do not constitute a guarantee, and reliance on marketing materials over official labels is at the customer’s own risk. The company and its staff, owners, employees, and representatives are not responsible and cannot be held liable fo any misleading or misinterpreted information, including that which results from reliance on marketing materials rather than the official product label.
Customers assume all risks associated with the use and consumption of food products sold by the Company. This includes any health complications, illnesses, or injuries resulting from consumption, such as allergic reactions, foodborne illnesses, physical injuries (such as choking), overconsumption, or misuse of the product. The Company is not responsible for any adverse health effects resulting from dietary choices, interactions with medications, pre-existing health conditions, or any other personal health circumstances.
The Company shall not be held liable for compliance with regulatory standards that may change over time. Any regulatory changes affecting product availability, labeling requirements, or ingredient sourcing are beyond the Company’s control. Claims including but not limited to organic, non-GMO, gluten-free, all natural, kosher, or halal convey no liability nor responsibility to the Company. The company is not responsible for any inaccuracies or change. Customers are responsible for interpreting regulatory terms used in product descriptions and ensuring their compliance with any dietary or lifestyle restrictions.
The Company shall not be liable for any failure to perform or delays in performance due to circumstances beyond its reasonable control (force majeure). This includes but is not limited to natural disasters (earthquakes, hurricanes, tornadoes, floods, wildfires), pandemics, epidemics, public health crises, government actions, regulatory changes, supply chain disruptions, strikes, labor disputes, production shutdowns, acts of terrorism, war, civil unrest, cyberattacks, hacking, or system failures affecting the Company’s website, payment processing, or business operations.
The Company also disclaims liability for any data security or privacy breaches, including but not limited to unauthorized access, loss, or theft of customer data despite reasonable security measures. The Company is not responsible for phishing scams, fraud, or identity theft resulting from customer interactions with the website or third-party payment processors. Customers are responsible for maintaining secure access to their accounts and payment methods and must report any suspected fraudulent activity immediately.
By purchasing or acquiring product from, or making a deposit with the Company, the customer acknowledges and accepts these exclusions of liability. The Company does not provide any express or implied warranties, including but not limited to warranties of merchantability or fitness for a particular purpose. The customer assumes all risks associated with the purchase, handling, preparation, and consumption of food products. The Company reserves the right to update these Terms and Conditions at any time without notice.
4. Other Circumstances
Regulatory and certification changes can also impact claims including but not limited to organic, non-GMO, gluten-free, all natural, keto-friendly, kosher, or halal certifications. Updates to government labeling laws, nutritional standards, or ingredient disclosure requirements may result in modifications to product claims. The Company does not guarantee continued compliance with specific certification standards if regulatory authorities revise their criteria or third-party verification processes change. Additionally, unexpected government-imposed restrictions, bans, or labeling modifications may alter how products are presented.
Manufacturing and processing differences can result in variations between batches of the same product. Differences in production facilities, equipment, or processes used by third-party manufacturers may impact final product formulation or introduce risks of cross-contact with allergens. Batch-to-batch variations in nutritional content, caloric values, or ingredient ratios are natural and unavoidable. Processing techniques, automation changes, or human error may also result in deviations in food characteristics, affecting consistency across multiple purchases.
Changes in ingredient sourcing due to supplier availability, pricing fluctuations, and seasonal ingredient variations may impact the composition of products. Unexpected substitutions or alterations in ingredients may be made by any party without prior notice, and may affect products, nutritional values, and allergen information. Customers acknowledge that such variations convey no liability nor responsibility to the Company.
Market conditions and economic factors, including inflation, price volatility, supply chain disruptions, and labor shortages, may affect product availability and ingredient sourcing. Fluctuations in packaging, branding, or promotional materials may occur based on market conditions or cost considerations. Variations in portion sizes, serving sizes, or net weight may be implemented in response to changes in supplier costs, industry trends, or consumer demand. Customers acknowledge that these changes are an inherent part of the food industry and do not constitute misrepresentation.
At its sole discretion, the Company reserves the right to modify, update, or discontinue product offerings, descriptions, or claims at any time without prior notice. Marketing materials, advertisements, and promotional messages are intended for general informational purposes only and do not constitute warranties or guarantees. The Company has full authority in determining whether a claim, certification, or description remains applicable to a given product. Customers acknowledge that the Company’s marketing materials are non-binding and that official government-stamped labels serve as the final authoritative source for product information. The Company makes no guarantees regarding the absolute accuracy or consistency of claims and is not liable for discrepancies arising due to these or other unforeseen factors.
Environmental and climate-related factors may also affect food quality, availability, and labeling claims. Seasonal fluctuations in food supply can impact the taste, texture, or appearance of ingredients. Natural disasters such as droughts, wildfires, floods, or extreme weather conditions may disrupt agricultural production, potentially affecting ingredient consistency. The accuracy of claims made by the Company, including but not limited to product descriptions, nutritional information, ingredient sourcing, certifications, and marketing statements, may be affected by a variety of circumstances. The Company does not guarantee that all claims will be accurate or applicable at all times due to external factors, changing conditions, and industry variations. Customers acknowledge that multiple factors may impact the accuracy and applicability of claims including but not limited to supplier and ingredient variability, regulatory and certification changes, manufacturing and processing differences, market conditions and economic factors, environmental and climate impact, storage and handling factors, consumer perception, and the discretion of the Company.
Storage, handling, and distribution factors may influence the final quality of food products. Variations in shipping and storage conditions, including extended transit times, exposure to temperature fluctuations, or improper handling by third-party carriers, may alter the freshness, texture, or taste of products. Shelf life may also be affected by how products are stored post-delivery, including refrigeration, freezing, and packaging integrity. Customers are responsible for ensuring proper storage conditions to maintain product quality, and the Company is not liable for any degradation occurring after delivery.
Consumer perception and individual differences further contribute to variations in how products are experienced. Factors such as taste preferences, dietary needs, nutritional absorption, and pre-existing health conditions may affect how a product is perceived or consumed. Subjective interpretations of marketing terms including but not limited to “premium quality,” “grass fed”, “all natural”, “farm fresh,” or “locally sourced” may differ among customers. The Company does not guarantee that all customers will experience the same product attributes, and marketing language is not intended to serve as a guarantee.
5. Customer Responsibilities
Customers are solely responsible for the proper storage, handling, preparation, and consumption of food products purchased from the Company. Upon delivery, customers must promptly inspect all labels, packaging, and product quality to ensure that the items meet their expectations and are in acceptable condition. If any discrepancies, defects, or concerns are identified, customers have the right to refuse the product at the time of delivery while a Company employee is present, in which case they will receive a full refund of their deposit. Once the delivery has been accepted, all liability shifts to the customer, and the Company is not responsible for any deterioration, spoilage, or other concerns arising after that point.
It is the customer's responsibility to ensure that all food products are stored according to USDA, FDA, and other applicable food safety guidelines. Perishable items must be refrigerated or frozen immediately upon delivery to maintain food quality and prevent spoilage. Customers must follow proper food handling procedures, including keeping raw and cooked foods separate, avoiding cross-contamination, and thoroughly washing hands and utensils before and after food preparation. The Company is not responsible for any foodborne illnesses, allergic reactions, or other adverse health effects resulting from improper storage, handling, or preparation by the customer.
Customers must also verify all product labels for accurate information, nutritional information, dates, and other product information. Any reliance on marketing descriptions rather than official product labels is at the customer’s own risk. The Company is not liable for health reactions, dietary issues, allergic reactions, or misinterpretations caused by failure to read and understand product labels. Customers with food allergies, dietary restrictions, or specific nutritional needs should exercise extra caution and consult a medical professional before consuming any new products. The Company’s products may contain unidentified allergens not listed on the label.
Once an order is placed, the customer is responsible for ensuring the accuracy of their shipping address, delivery details, and payment information. The Company is not liable for failed deliveries due to incorrect address information provided by the customer. Additionally, the customer must ensure that someone is available to receive perishable items at the scheduled delivery time, as the Company is not responsible for spoilage due to unattended deliveries or improper storage after receipt.
By making a purchase, customers acknowledge that they assume full responsibility for the safe and proper use of food products. Any complaints or concerns about product must be reported to the Company while the Company’s representative or staff is present during the delivery. Customers further agree that they will not hold the Company liable for any damages, injuries, illnesses, or losses resulting from the consumption or handling of food products. Customers accept these responsibilities as part of their agreement to these Terms and Conditions.
6. Indemnification
Customers agree to indemnify and hold harmless the Company from any claims, losses, liabilities, or expenses arising from their failure to adhere to these Terms and Conditions.
7. Severability
If any part of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.
8. Conflict of Terms
In the event of any conflict between these Terms and Conditions and any other communications, including but not limited to texts, emails, phone calls, or oral communications, the provisions of these Terms and Conditions shall prevail.
9. Additional Provisions
The Company reserves the right to modify these Terms and Conditions at any time without prior notice. By purchasing from the Company, customers acknowledge that they are aware of their legal obligations with respect to the purchase and consumption of the Company's products.
